Terms and Conditions

Your access to this website is subject to these Terms and Conditions and any disclaimers or other conditions or statements contained on this website (referred to collectively as "Terms and Conditions"). By using this website you agree to be subject to these Terms and Conditions. BabyCakes may at any time, at its sole discretion, amend, vary or modify these Terms and Conditions without notice. Please read the following Terms and Conditions carefully before placing your order with BabyCakes. By using the BabyCakes, you agree to be bound by these Terms and Conditions. Modifications to this site including these Terms and Conditions will be effective immediately and any subsequent use by you of the website will constitute an acceptance of those modifications. Please re-read these terms and conditions before subsequent use. We reserve the right to refuse the sale of goods or services or to cancel an order under certain circumstances


A 50% deposit is required to confirm a booking and the deposit will be deducted from the final balance payable. For orders over $100.00 credit card details must be provided. Once the deposit has been paid, the quoted price remains fixed to the details listed in the quote. No order will be commenced until such time as a deposit has been paid.

Balance Due

For deliveries, the balance of payment is due 14 days prior to delivery, unless full payment has been received goods will not be delivered. If you are collecting your order, full payment is due upon collection.


If you cancel your order within 7 days of the delivery or collection date your deposit will not be refunded and any balances outstanding will be due and payable. Cancellations must be received in writing. If you cancel more than 7 days prior to the delivery date, the deposit will be refunded minus a $50 cancellation fee.

Confirmation of Orders

Once the details of your order have been recorded you will be emailed a copy. Please ensure all contact details, personal information, spelling of names, delivery/collection dates and times and any requested changes have been properly documented. Please notify our staff immediately of any errors on your invoice. Failing to notify us of any errors may result in additional charges where alterations are necessary after your order has been completed.


Any changes made to your order within 7 days of collection or delivery will incur a surcharge, depending on the change requested. In most cases we can accommodate changes, however at times it is not possible. We will however endeavor to accommodate you to the best of our ability.


At babyCakes we pride ourselves on the quality of our products and services. It is important to remember that cakes are a perishable and delicate product. Our aim is to provide only the freshest and highest quality cakes to our customers. Unfortunately once we dispatch our cakes or our customers take possession of them, a number of factors relating to the care and transportation of the cakes may result in the quality being compromised or damage occurring to the cakes that are beyond our control or responsibility. Care instructions must be followed thoroughly in order to avoid compromising the cakes quality, freshness and design. Unfortunately, with all the possible variables, it is difficult for babyCakes to guarantee the cake quality in every case once it has left our premises.

Variations from pictured items

In some cases it may be necessary to change a colour or vary a product from the picture in our display books or on our website as certain cake decorating items may from time to time be unavailable. Please note that where colours are concerned, the pictures represented on our website may not be a true representation of the colour of the cake as quite often screen colours are not correct and therefore your cake may appear to be different in colour from that shown. Any cake ordered from a picture or photo of a cake produced by any other cake maker, can only be reproduced by babyCakes as our interpretation of that cake and will not be an exact reproduction of the cake in the picture or photo.


As each cake is unique, so too, are your special requirements and concerns surrounding your order. If you have found that for any reason the cake you ordered did not meet your expectations then please contact us via telephone or email. A number of resolutions may be available to you and are subject to your particular situation. If there is an issue with your order please note that you must refrigerate or freeze the cake immediately and return it to us on the next business day if we are to consider a refund. Note: All refunds for orders placed online or over the telephone are credited back to the original credit card on which the order was purchased. Refunds for in-store purchases may be processed through the original credit card for which the order was purchased or by EFTPOS only

Disclosure of Information

babyCakes will not disclose any personal information such as your name, address, email, telephone number to any person outside of the company, unless the customer has authorised us to do so or unless required by law to disclose such information.


All our ingredients are of the highest quality. Our cakes are made to be eaten on the day of the celebration. The cakes are made in premises in which nuts are used, every effort is taken to keep ingredients separate however cakes may contain traces of nuts or nut oil.


Sugar paste (the soft icing covering the cake) is not designed to be refrigerated and as such cakes with this icing should be stored in a cool dry place, preferably in the box they were supplied in, refrigeration may cause colours to run.

Cake Stand Hire

All equipment must be collected and returned by the customer. The full hire charge is taken upon booking and credit card details are taken as the bond. A charge will be made for late return ($10 per day) and the bond ($350.00) will be taken from your credit card if not returned within 3 days. Damage or loss of equipment (or any part thereof) will also result in the bond ($350.00) will be taken from your credit card Collection and return times can be varied by individual arrangement to suit the customer only if agreed in advance of hire.


Cakes will be delivered and set up subject to availability; any arrangements for delivery may be subject to change, however prior notice will be given where possible. Cakes are to be collected from our premises at a prearranged time and date only. If babyCakes provides delivery, all liability ceases once the cake is delivered and set up at the venue. We prefer as much notice as possible for deliveries, and require a minimum notice of 7 Days.

Agreement to Terms and Conditions

By proceeding with a purchase you are in agreement with our terms and conditions as stated above.
